There was limited support, documentation and contact to provide confidence that the Software Escrow Agreement was being performed and managed effectively.
SES were approached by Constantine Wind Energy and their critical software developer to provide an improved level of escrow protection to ensure that Software Escrow Solution was fit for purpose in the event of a trigger to the Escrow Agreement. SES delivered a bespoke Individual Licensee Software Escrow Agreement that had been tailored to reflect the policies of both the Licensor and Licensee as well as mirroring the terms of software support contract.
Constantine Wind Energy now has a fit for purpose Software Escrow Solution that is clear, meaningful and on an agreed set of terms that is simple to manage and provides peace of mind that their mission critical application is correctly protected now and in the future. Reports are made often and there is always a representative on hand to answers any questions or concerns.
